Effective July 2026 — Advantage

These Terms and Conditions ("Agreement") govern the use of air freight services provided by Advantage ("Company") for the importation of auto parts from the United States to Ghana. By creating an account and using our services, you agree to be bound by this Agreement in full.

1. Definitions

Company: Advantage, a freight and logistics service provider operating US-to-Ghana air freight services for auto parts.
Customer: Any individual, business, or entity that engages the Company for freight or purchase assistance services.
Shipment: Any auto parts or related goods consigned to the Company for air freight to Ghana.
Auto Parts: Vehicle components, spare parts, accessories, and related mechanical goods accepted under this Agreement.
US Address: The Company's designated US receiving address where customers send their shipments.
Purchase Assistance: A service where the Company sources and purchases auto parts on behalf of the Customer from US suppliers.
Customs Clearance: The process of obtaining permission from Ghanaian customs authorities to import goods into Ghana.
Third Parties: Airlines, customs brokers, delivery agents, and any other external service providers involved in the shipping process.

2. Scope of Service

2.1 What We Do: The Company provides air freight services for auto parts from the US to Ghana, including receiving, consolidation, air transport, customs clearance assistance, and last-mile delivery within Ghana.

2.2 What We Don't Do: The Company does not ship general merchandise, personal effects, electronics unrelated to vehicles, or items prohibited under Ghanaian import law.

2.3 Company as Agent: The Company acts as a freight agent and not as a carrier. Actual carriage is performed by third-party airlines and logistics providers.

2.4 Right to Refuse: The Company reserves the right to refuse any shipment at its sole discretion without obligation to provide a reason.

3. Accepted & Restricted Items

3.1 Accepted: Engine parts and components, transmission parts, brake systems, suspension and steering parts, electrical components for vehicles, body parts and panels, tyres and wheels, lubricants (sealed and properly packaged), batteries (dry/sealed only), and general auto accessories.

3.2 Restricted / Prohibited: Used oils or fluids, items containing flammable liquids or gases, counterfeit or trademark-infringing parts, items prohibited under US export laws or Ghana import regulations, weapons or weapon components, and any item the Company deems unsafe for air transport. Prohibited items will be rejected; any costs incurred in handling or returning prohibited items are borne by the Customer.

4. Customer Responsibilities

4.1 Accuracy: The Customer is responsible for providing accurate and complete information about their shipments, including item descriptions, weights, dimensions, and declared values.

4.2 Documentation: The Customer must provide all required documentation, including purchase invoices, packing lists, and any permits required for import of specific auto parts into Ghana.

4.3 Identity Verification: The Company may request government-issued identification before releasing shipments. Failure to provide valid identification may result in the shipment being held.

4.4 Compliance: The Customer is responsible for ensuring that all items shipped comply with applicable US export laws and Ghanaian import regulations.

4.5 Condition of Parts: Parts must be properly packaged for air freight. Used parts must be clean and free of residual fluids. The Company is not responsible for damage caused by inadequate packaging.

5. Customs Clearance

5.1 Our Role: The Company will assist with customs documentation and work with licensed customs brokers to clear your shipment in Ghana.

5.2 What We Cannot Control: The Company cannot guarantee specific clearance timelines, as customs decisions are made solely by Ghana Revenue Authority (GRA) and Ghana Customs Division officials.

5.3 Communication: The Company will notify Customers of any customs queries, holds, or additional documentation requests within 24 hours of being informed.

5.4 Duties and Taxes: All import duties, taxes, and customs fees are the sole responsibility of the Customer. The Company will provide advance estimates where possible, but actual amounts are determined by Ghana Customs.

5.5 Seized Goods: If goods are seized by customs authorities, the Company will assist in the retrieval process but cannot guarantee release. Legal costs and fines arising from seizure are the Customer's responsibility.

6. Insurance — Mandatory on All Shipments

6.1 Coverage: All shipments are covered by cargo insurance from the time they are received at the US address until delivery in Ghana. Insurance is mandatory and non-waivable.

6.2 Declared Value: Customers must declare the accurate value of their shipment. Insurance coverage is based on the declared value. Under-declaration voids the insurance claim for the undeclared portion.

6.3 Claims Process: Claims must be submitted in writing within 7 days of delivery (or expected delivery) with supporting documentation including photos, receipts, and a written description of the damage or loss.

6.4 Exclusions: Insurance does not cover damage caused by inadequate packaging, inherent defect of the goods, delay, or items not declared at the time of shipping.

6.5 Company Liability: The Company's maximum liability in any event is limited to the declared value of the shipment, not exceeding actual insurance coverage. The Company is not liable for consequential, indirect, or special damages.

7. Shipment Charges & Payment

7.1 Charges are calculated based on the greater of the actual weight or the volumetric weight (L × W × H in cm ÷ 6000) of the shipment, multiplied by the applicable rate per kilogram.

7.2 All charges are quoted and payable in US Dollars (USD).

7.3 Payment is due before the shipment is released for delivery in Ghana, unless a credit arrangement has been agreed in writing.

7.4 The Company reserves the right to hold shipments pending payment of outstanding charges.

7.5 Rates are subject to change with 14 days' notice. Existing booked shipments will not be affected by rate changes.

7.6 Purchase Assistance: For Purchase Assistance services, the Customer must provide full payment (item cost + service fee + estimated shipping) before the Company will place the order. Refunds are issued only if the Company is unable to source the item. No refunds for items already purchased or shipped.

8. Transit & Delivery

8.1 Estimated transit times are provided in good faith but are not guaranteed. Delays caused by weather, airline schedules, or customs are beyond the Company's control.

8.2 The Company will notify the Customer upon arrival of shipment in Ghana and coordinate delivery to the address on file.

8.3 The Customer or an authorised representative must be available to receive the shipment at the agreed delivery address.

8.4 Redelivery fees may apply if the Customer is unavailable at the time of delivery without prior notice.

8.5 Unclaimed shipments held at the Company's Ghana facility for more than 5 business days after notification may attract daily storage fees.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any loss of profit, loss of business, indirect, incidental, special, punitive, or consequential damages arising out of or in connection with the services provided, even if the Company has been advised of the possibility of such damages.

10. Right to Inspect

The Company reserves the right to inspect any shipment at any time for safety, legal compliance, or security purposes. Customers consent to such inspections by using our services.

11. Confidentiality

The Company will keep Customer information confidential and will not share personal data with third parties except as required to perform the shipping service (e.g., customs brokers, airlines, delivery agents) or as required by law.

12. Conduct & Safety

The Company reserves the right to terminate service and refuse further business with any Customer who engages in fraudulent activity, provides false documentation, or behaves in a manner harmful to Company staff, agents, or other customers.

13. General Provisions

This Agreement is governed by the laws of the State of Georgia, United States. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts of the State of Georgia. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between the Company and the Customer with respect to the services described herein.
